Federal law ERISA requires most employer-sponsored health plans to have a Summary Plan Description (SPD). The failure to have and distribute a compliant SPD can expose the employer to fines, penalties and Department of Labor audits or even lawsuits. And unfortunately, the documents provided by insurance companies don’t typically constitute an SPD.
