J.W. Terrill Supports Reinvest North County Fund

In honor of the people who live, work and go to school in the city of Ferguson and surrounding communities, J.W. Terrill has made a donation to the Reinvest North County Fund, organized by The St. Louis Regional Business Council (RBC) to support small business owners and school children who were impacted by the recent tragedy in the city of Ferguson and surrounding communities.

The purpose of the Reinvest North County Fund is twofold: first to provide immediate relief to small business which have been hurt by this tragedy and second, to provide the school districts with appropriate resources to show their children how important school is, particularly in times of distress.

Further donations are encouraged to support this effort; checks can be made payable to the Reinvest North County Fund at the 501(c)3 non-profit North County Regional Development Association (NCI), 350B Village Square Drive, Hazelwood, MO 63042.

The St. Louis Post-Dispatch has recognized 90 St. Louis organizations as Top Workplaces. The selection is based solely on employee feedback from a survey distributed to employees. Illinois Workers’ Compensation Law Changes

Illinois Governor Pat Quinn signed the workers’ compensation legislation on June 28, 2011.  Below are some key highlights of HB1698.  Unless otherwise noted these changes are effective June 28, 2011.  To view the full Amendment #3 please follow this link:

Burden of Proof/Causation Standard (Page 24):
To obtain compensation under this Act, an employee bears the burden of showing, by a preponderance of the evidence, that he or she has sustained accidental injuries arising out of and in the course of the employment.

Collective Bargaining Pilot Program (Page 46):
Will be effective once the State of IL develops the program and rules, could be several months.

The Director of the Department of Labor is to designate 2 labor organizations to participate in the collective bargaining process provided for this Section.  Limited to “construction employers” only, in which those employers and the unions representing their employees can essentially create their own workers’ compensation system, preferred medical providers and alternative dispute resolution procedures to resolve disputed claims outside of or in supplement to the Commission.  The workers compensation insurer must agree to any contractual agreements.

Preferred Provider Programs (Page 87):
Will be effective once the State of IL develops the program and forms for application process, could be several months.

Employers will be able to utilize preferred provider programs, through which their employees must treat with providers in that network for injuries claimed to arise out of and in the course of employment.  There are specific requirements as to having an adequate number of occupational and non-occupational providers.  The providers must be in an area where the employee resides, not where the work place is located.  There is a notification process to the employees and they can opt out of the program in writing before experiencing any injury but must give up one of their two choices of providers.  The workers’ compensation insurers will be the ones to apply for the program and employers will be able to use the network.

Wage Differential Awards (Page 65):
Effective on injuries on or after September 1, 2011

An award for wage differential under this subsection shall be effective only until the employee reaches the age of 67 or 5 years from the date the award becomes final, whichever is later.

Carpal Tunnel Hand Injuries (Page 69):
These claims will be capped at 15% loss of use of the hand, based on 190 weeks vs. current 210 weeks full loss of use of hand.  When there is clear and convincing evidence that the award should be higher (multiple surgeries, etc.), then award may be no higher than 30%.

AMA Guides (Page 93):
A physician licensed to practice medicine will now have to issue impairment ratings in conjunction with the AMA Guidelines for Permanent Partial Disability findings.  The Commission must then base their PPD awards from these impairment ratings unless there are unusual circumstances like age, occupation and future earning capacity that may affect the rating.

Medical Fee Schedule (Page 96):
Effective on injuries on or after September 1, 2011

There will be 30% reduction across the fee schedule amounts as a whole.  Effective January 1, 2012, the structure of the fee schedules will undergo major changes.

Alcohol and Drug Intoxication (Page 116):
Effective on injuries on or after September 1, 2011

No compensation shall be payable if the employee’s intoxication is the proximate cause of the employee’s accidental injury or at the time the employee incurred the accidental injury, the employee was so intoxicated that the intoxication constituted a departure from the employment.  The levels indicated by tests obtained at the time of the injury will be considered in any hearing under this Act to determine whether the employee was intoxicated at the time the employee incurred the accidental injuries.  If an employee refuses testing for drugs or alcohol, then there shall be a rebuttable presumption that t he employee was intoxicated at the time of the injury.

Other provisions (various pages):
There are a number of other provisions that revolve around workers compensation reporting by insurers and premium and rate adjustments along with new fraud penalties.  Please see the entire Amendment referenced at the link above for more information.

Our suggestions of things you can do to be prepared for these changes:

1)      Implement a drug and alcohol program for post injury testing.  Ensure your employee(s) sign a form if they refuse the testing.   Forms are available for J.W. Terrill clients on www.jwterrill.com in the Document Library.

2)      Ensure you conduct a thorough investigation into the alleged accidental injury as causation is now the burden of the employee.

3)      Once the Preferred Provider Program is up and running, ensure that you have a listing of providers from your carrier so you may direct the employee for treatment.
